Terms of use

These terms apply to everyone who uses enclave.co.ke (the “site”), run by Enclave Real Estate (“Enclave”, “we”, “us”), Nyali, Mombasa, Kenya. By using the site you accept them. If you do not accept them, please do not use the site.

1. What Enclave does

Enclave markets, sells, leases, values and manages property on the Kenya coast. On many listings we act as agent for the developer or owner, not as the owner. Where that matters to you, ask us who the seller is before you commit.

2. Listings are information, not offers

• Every listing, price, plot size, layout, completion date and availability status on the site is a general guide and an invitation to talk. It is not an offer that can be accepted, and it is not a contract.
• Prices and availability change without notice. A unit or plot shown as available may already be reserved or sold.
• Plot areas and boundaries may be from proposed subdivision plans and are subject to final survey and approval by the relevant authorities.
• Completion dates are targets set by the developer and can move.
• Nothing on the site binds Enclave, a developer or an owner until a written sale, lease or reservation agreement is signed by the parties.

3. Images, renders and videos

Many images and videos on the site are computer-generated renders, artist impressions or concept visuals. They show what a property or a home on a plot could look like. They are not photographs of finished buildings, and finishes, furniture, landscaping, views and neighbouring buildings may differ. The specification in your signed agreement is what counts.

4. Reservations and enquiries

• Sending a form on the site is an enquiry or a request to reserve. It does not reserve or sell anything by itself.
• A reservation only exists once Enclave confirms it in writing and any reservation terms, including any deposit and refund terms, are set out in a signed reservation form.

5. Payments and fraud warning

• Never pay any money to a personal account, a mobile money number or a person because of a message, call or social media post that claims to be from Enclave.
• Only pay into the account named in a signed agreement, and confirm the account details by calling Enclave on +254 728 99 88 77 before you pay.
• Enclave is not liable for money paid to anyone other than the account named in your signed agreement.

6. Do your own checks

Nothing on the site is legal, tax, valuation, investment or financial advice. Before you buy, have your own advocate carry out a title search and review all agreements. Any yields, rental figures or growth figures on the site are illustrations, not guarantees.

7. Content and intellectual property

The text, design, photographs, renders, plans, videos and logos on the site belong to Enclave or are used with permission from their owners. You may view and share links to the site for personal use. You may not copy, republish, sell or use our content to advertise property without our written permission.

Music, footage or other material in our videos that belongs to third parties remains theirs. If you own content on the site and believe it is used without the right permission, email info@enclave.co.ke with the page, the content and proof of ownership. We will review it promptly and remove or replace it where appropriate.

8. Using the site

Do not misuse the site: no false enquiries, no attempts to break into or overload it, no scraping of listings or personal data, and no use of the site to impersonate Enclave or its staff.

9. Links to other sites

The site links to services we do not control, such as WhatsApp, maps and social media. Their own terms and privacy policies apply, and we are not responsible for their content.

10. Limitation of liability

We work to keep the site accurate, but it is provided as it is, and we do not promise it is complete, current or free of errors. To the extent the law allows, Enclave is not liable for any loss arising from reliance on information on the site, from the site being unavailable, or from decisions made without a signed agreement. Nothing in these terms limits any liability that cannot be limited under the laws of Kenya.

11. Changes

We may update these terms at any time. The date at the top of this page shows the latest version. Continued use of the site means you accept the updated terms.

12. Law and disputes

These terms are governed by the laws of Kenya. Any dispute will first be discussed in good faith; if it cannot be settled, the courts of Kenya have jurisdiction.
